These Terms of Service (“Terms”) govern your access to and use of shopevernext.com (the “Site”) and your purchase of products and services from EverNext LLC (“EverNext,” “we,” “us,” or “our”).
By using the Site or submitting an order, you agree to these Terms and our Privacy Policy, Shipping Policy, and Return and Refund Policy.
- Eligibility
You must be at least the age of majority in your place of residence to place an order or create an account, or you must use the Site with the involvement and permission of a parent or legal guardian.
You may not use the Site or our products for unlawful or unauthorized purposes.
- Shopify
Our store is hosted by Shopify, which provides the ecommerce platform used to offer our products and services.
Purchases made through the Site are transactions between you and EverNext. Shopify is our technology provider and is not the seller of EverNext products.
- Customer Information and Accounts
You agree to provide current, complete, and accurate account, billing, shipping, and payment information.
You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.
We may suspend or terminate an account where reasonably necessary to prevent fraud, abuse, security risks, or violations of these Terms.
- Products and Product Information
We make reasonable efforts to display product descriptions, photographs, dimensions, colors, contents, and prices accurately. Screen settings, lighting, photography, packaging updates, and manufacturing variations may cause minor differences.
Product measurements may have reasonable manufacturing tolerances. Packaging and included materials may change when the product’s essential function and value remain substantially the same.
We reserve the right to modify or discontinue products and limit quantities, subject to applicable law.
- Product Use and Safety
Customers must read and follow all instructions, age recommendations, warnings, and safety information shown on product pages, packaging, labels, and instructions.
Some craft and DIY products may contain small parts, tools, adhesives, or other materials that require careful handling or adult supervision.
EverNext is not responsible for harm caused by misuse, unauthorized modification, failure to follow instructions, or use contrary to displayed safety information, except where liability cannot legally be excluded.
- Prices, Taxes, and Payment
Prices are shown in U.S. dollars unless otherwise stated.
Prices, promotions, and availability may change without notice. Applicable shipping charges and taxes will be displayed at checkout before payment is submitted.
You agree to provide a valid payment method and authorize the applicable payment provider to charge the amounts associated with your order.
- Orders and Acceptance
Submitting an order is an offer to purchase. An order-confirmation email acknowledges receipt but does not necessarily mean the order has been accepted.
We may reject or cancel an order for legitimate reasons, including product unavailability, pricing errors, payment failure, suspected fraud, shipping restrictions, quantity limitations, or violations of these Terms.
If we cancel a paid order, the amount charged for the canceled portion will be refunded to the original payment method.
- Shipping, Returns, and Refunds
Shipping areas, charges, estimates, tracking, address requirements, delivery issues, and delays are governed by our Shipping Policy.
Returns, damaged or missing items, exchanges, cancellations, and refunds are governed by our Return and Refund Policy.
These policies form part of these Terms.
- Promotions and Discount Codes
Promotions may be subject to expiration dates, product exclusions, geographic restrictions, quantity limits, and minimum purchase requirements.
Unless expressly stated otherwise, promotions cannot be combined, redeemed for cash, or applied retroactively.
- Prohibited Uses
You may not:
• Use the Site for illegal, fraudulent, harmful, or deceptive activity;
• Violate intellectual-property, privacy, publicity, or other rights;
• Submit false or misleading information;
• Upload viruses, malware, or harmful code;

• Use the Site to harass, threaten, discriminate against, or harm others.
- Intellectual Property
The Site and its content, including text, graphics, photographs, product descriptions, designs, logos, trademarks, videos, and software, are owned by or licensed to EverNext and protected by applicable intellectual-property laws.
You may use the Site only for personal, non-commercial shopping purposes. Site content may not be copied, reproduced, distributed, modified, sold, or commercially exploited without written permission.
- Reviews and Submissions
If you submit reviews, photographs, comments, or other content, you represent that you have the right to submit it and that it does not violate any law or third-party right.
You grant EverNext a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, and distribute submitted content for operating and promoting our business, subject to applicable privacy law.
- Third-Party Services and Links
The Site may use or link to third-party payment, shipping, analytics, social-media, or advertising services.
EverNext does not control and is not responsible for third-party websites, content, terms, privacy practices, products, or services.
- Privacy
Our collection and use of personal information are described in our Privacy Policy.
Information may be processed by Shopify and other service providers necessary to operate the Site, process payments, fulfill orders, prevent fraud, and provide services.
- Errors and Corrections
The Site may occasionally contain inaccurate information or omissions relating to descriptions, pricing, promotions, availability, shipping charges, or delivery estimates.
We reserve the right to correct errors, update information, and cancel affected orders. If a paid order is canceled because of an error, the applicable amount will be refunded.
- Disclaimer of Warranties
To the maximum extent permitted by law, the Site and its content are provided on an “as is” and “as available” basis.
We do not guarantee that the Site will always be uninterrupted, error-free, secure, or free from harmful components.
Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
- Limitation of Liability
To the maximum extent permitted by law, EverNext and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the Site or purchase of products.
Where liability may lawfully be limited, EverNext’s total liability relating to a product or order will not exceed the amount paid for that product or order.
Nothing in these Terms limits liability that cannot legally be limited.
- Severability and Waiver
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect.
A failure to enforce a provision does not waive the right to enforce it later.
- Termination
We may suspend or terminate access to the Site for material violations of these Terms, fraud, abuse, illegal activity, or conduct that threatens the Site or other users.
- Governing Law
These Terms are governed by the laws of the State of Washington and applicable federal laws of the United States, without regard to conflict-of-law principles.
Nothing in this section prevents a consumer from relying on mandatory protections available under applicable law.
- Changes to These Terms
We may update these Terms periodically. Updated Terms will be posted on the Site with a revised “Last Updated” date.
